Terms of Sale

These Terms of Sale ("Terms") govern every purchase made on this store, which is operated for Patrick Kelly Wise Fine Artby Personal Graphics of Petoskey, Michigan ("Personal Graphics," "we," "us"). By placing an order you agree to these Terms. If you do not agree, do not order.

1. Made-to-order products

Every item is custom-decorated after you order it. Target production time is 10 business days from payment, after which your order ships; the estimated ship-by date shown at checkout is a good-faith estimate, not a guaranteed delivery date. Production and carrier delays outside our reasonable control (including supplier shortages, equipment failure, weather, or carrier disruption) do not entitle you to cancellation or damages, though we will always tell you promptly and work to make things right.

2. What you see is what we print

The product preview is the production file: logo artwork, placement, and size print as shown. However, on-screen colors vary by display, and modest variation between screen color and printed ink or fabric color — and industry-standard placement tolerance of up to one inch — is normal and not a defect.

3. Cancellations, returns & our guarantee

You may cancel only before your order enters production — email us immediately after ordering if you need a change. Because every item is custom-decorated, completed items cannot be returned or exchanged for sizing, fit, or change of mind; size charts are provided on each product page and choosing the right size is your responsibility. If we made a mistake — a misprint, a manufacturing defect, the wrong item, or shipping damage — notify us within 14 days of delivery with photos and we will, at our option, remake the item or refund it. That remake-or-refund is your exclusive remedy and our sole obligation for any order issue.

4. Pricing & payment

Prices include decoration as configured; volume price breaks are based on each order's total quantity and may change as you add or remove items before checkout. Sales tax and shipping are added at checkout, which is processed by Shopify. In the event of an obvious pricing or system error, we may cancel the affected order and issue a full refund rather than fulfill at the erroneous price.

5. Artwork & intellectual property

Logos and artwork offered on this store are provided by or on behalf of Patrick Kelly Wise Fine Art, which represents that it owns or is licensed to use them. By operating this store at its request, we rely on that representation; Patrick Kelly Wise Fine Artagrees to indemnify and hold Personal Graphics harmless from any claim that artwork it supplied infringes a third party's rights. Purchasers receive decorated goods for personal use and no license to reproduce any artwork. The store design and software are the property of Personal Graphics.

6. Disclaimer of warranties

Except for the remake-or-refund guarantee in Section 3, products and this website are provided "as is" and we disclaim all other warranties, express or implied, including merchantability and fitness for a particular purpose, to the maximum extent permitted by law. Garment care instructions are provided on each product page; damage from improper care is not a defect.

7. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from an order or this website is limited to the amount you paid for the affected order, and we are not liable for indirect, incidental, special, or consequential damages (including lost profits or missed events), even if advised of the possibility. Some states do not allow certain limitations, so portions of this section may not apply to you.

8. Indemnification

You agree to indemnify Personal Graphics against claims arising from your violation of these Terms or your misuse of this website.

9. Governing law & disputes

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Emmet County, Michigan, and you consent to their jurisdiction. Any claim must be filed within one year of the event giving rise to it. If any provision of these Terms is held unenforceable, the remainder stays in effect.
